2. Collection of Information

We collect personally identifiable information like names, postal addresses, email addresses, etc. when voluntarily submitted by our visitors.  We will not share that information with any other organization or individual.  We may contact you from time to time with offers, news or updates, but if you reply and ask us to remove your name from our list, we will do so promptly.

All content included on this site, including but not limited to text, graphics, logos, icons, clips, downloads, data compilations and software is the property of Choral Arts or its content suppliers and protected by US and international copyright laws.  The compilation of all content in this site is the exclusive property of Choral Arts, with copyright authorship by Choral Arts.  You may not reproduce, distribute, transmit, display, prepare derivative works, or perform any copyrighted material on the Choral Arts website without the prior written consent of Choral arts, except as provided below.  You may copy and print a limited amount of content for your personal, non-commercial use only, provided that you include all copyright and other notices contained in the content and that your do not modify the content.  For permission requests, email admin@choralarts-newengland.org.

4. User Content Submissions; Agreements as to Proper Use of Website

Any content posted or otherwise submitted by you shall be subject to these Terms of use.

You are solely responsible for all content that you upload, post, transmit or otherwise make available on the Choral Arts website.  Choral Arts does not control posted content and does not guarantee the accuracy, integrity or quality of such content.

You agree to evaluate, and bear all risks associated with, the use of any content on this website.  Choral Arts is not liable for any loss or damage of any kind on account of the use of [user] content made available through the Choral Arts website.

You acknowledge that Choral Arts has no obligation to pre-screen or monitor contact on the website, and also acknowledge that Choral Arts reserves the right to refuse to post or to remove material, for any reason or for no reason.

7. License and Site Access and Use

Choral Arts grants you a limited license to access and make personal us of this site, but not to download (other than page caching) or modify it except with the express written consent of Choral Arts, other than by adding listings as expressly permitted.  If you do post content or submit material, you grant Choral Arts and its associates a nonexclusive, royalty-free, perpetual, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content throughout the world in any media.  You grant Choral Arts and its associates and sublicensees the right to use the name that you submit in connection with such content, if they choose.

This license does not include any resale or commercial use of this site or its contents, any derivative use or this site or its contents, any downloading or copying of information for the benefit of another company or individual, or any use of data mining, robots, or similar data gathering or extraction tools.  No portion of this site may be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose with express written consent of Choral Arts.  You are granted a limited, revocable and nonexclusive right to create a hyperlink to the home page of this website so long as the link does not portray Choral Arts, its associates, or their products or services in a false, misleading derogatory or otherwise offensive manner.

8. Miscellaneous; Choice of Law; Modifications

We may modify these terms of use at any time and from time to time in writing posted on this website.  No exceptions shall be valid unless made in writing.  The terms of use shall be governed by the law of the Commonwealth of Massachusetts without regard to its choice of law rules, and where applicable, the laws of the United States.  To the extent permissible by law, any disputes shall be submitted to confidential arbitration in Boston, MA, except that Choral Arts reserves the right to seek relief for any violation or threatened violation of its intellectual property rights in any state or federal court, and you consent to the exclusive jurisdiction and venue in such courts.  Arbitration shall be conducted under the then prevailing rules of the America Arbitration Association.  The arbitrators’ award shall be binding and may be entered as a judgment by any court of competent jurisdiction.  No arbitration shall be joined to an arbitration involving any other party subject to these terms of use, whether through class arbitration proceedings or otherwise.  If any of these terms of use shall be deemed invalid, void, or for any other reason unenforceable, that term shall be deemed severed and shall not affect the validity and enforceability of any other term.
